OFFICIAL CONTEST RULES AND REGULATIONS
By participating in the “Enter for a Chance to Win a Sunweld Mini Fridge” Contest (the “Contest”), you are signifying your agreement that you have read and agree to be legally bound by these official contest rules and regulations (the “Rules”). The decisions of Mark Anthony Group Inc., a BC company, (the “Sponsor”) with an office at 1209 King Street West, Unit 200, Toronto, Ontario M6K 1G2, with respect to all aspects of the Contest are final and binding.
- CONTEST PERIOD. The Contest begins at 12:00:01 am Eastern Time (“ET”) on May 14, 2026 and ends at 11:59:59 pm ET on May 20, 2026 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or networking equipment is the official time-keeping device for the Contest.
- ELIGIBILITY. To enter the Contest and be eligible for a chance to win a prize a person (the “Entrant”) must be a legal resident of Canada who have reached the legal drinking age in their province or territory of residence at the time of entry. Persons are not eligible to enter if they: a) are an employee, director, representative, agent or officer of the Sponsor, its parent companies, subsidiaries, affiliates, advertising or promotional agencies, prize suppliers, or any other individual or entity involved in the development, production, administration or fulfillment of the Contest (collectively the “Contest Parties”); b) are an employee of or contractor to any provincial liquor authority or any participating licensed establishment; or c) are a member of the immediate family (defined as parents, siblings, children, spouse and life partner, regardless of where they live) or household (whether related or not) of any of the above-referenced persons.
- HOW TO ENTER: No Purchase Necessary. A purchase will not improve your chances of winning. Internet access and an active Instagram account required. Online entry through Instagram only; no other means of submission will be accepted.
To enter via Instagram:
- At or near the beginning of the Contest Period, the Sponsor or its designated representative will post one (1) Contest-related post (the "Contest Post") at www.instagram.com/sunwelddistilling (the "Instagram Contest Page");
- To enter, you must log in to your Instagram account (or create an account at www.instagram.com), visit the Instagram Contest Page during the Contest Period, locate the Contest Post and complete the steps below:

- In the comments section of Contest Post, include the hashtag #ContestEntry and tag at least one (1) friend who is at least 19 years of age
Once you have completed all of the foregoing steps to enter (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive an entry (an “Entry”).
Entries: To be eligible, all entry elements associated with your Entry and/or the Entrant’s account must: (i) be publicly shared; (ii) not be deleted or altered during the Contest Period; (iii) be submitted and received in accordance with these Rules during the Contest Period; (iv) includes all required components/elements required in Rule 3; (v) be in accordance and compliant with these Rules; and (vi) be in accordance and compliant with the applicable terms, rules, policies and guidelines of Instagram (the “Instagram Rules”).
Entry Limit: You may enter the Contest more than once provided that no one (1) person is tagged by you in more than one Entry. For clarity, each comment counts as one (1) entry, regardless of how many friends are tagged. Only one (1) tagged friend per comment will be considered. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses, and/or Instagram accounts; (iii) use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; and/or (iv) disrupt or participate in the Contest in any other fraudulent, abusive, deceptive, unfair or misleading way; then the Entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Entry is not submitted and received in accordance with these Rules or Instagram Rules during the Contest Period; and/or (ii) the Entry is not otherwise in compliance with these Rules or Instagram Rules (all as determined by Sponsor in its sole and absolute discretion).
Standard message and data rates may apply to participants who choose to participate in the Contest through a mobile device or other electronic devices. Please contact your service provider for pricing and service plan information and rates before any mobile or electronic device participation.
- PRIZE. Alcohol is not part of the prize. There will be one (1) Prize (the “Prize”). The Prize consists of: Sunweld Branded Mini Fridge. The Prize is provided by the Sponsor. The approximate retail value (“ARV”) of the Prize is two hundred fifty Canadian dollars ($250 CAD).
There is a limit of one (1) Prize per person. No more than the advertised number of prizes will be awarded. The Prize will only be released to the verified winner. Arrangements for Prize delivery will be confirmed with the potential winner by e-mail, telephone or Instagram (direct message or tagged post). Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.
Without limiting the foregoing, the following terms and conditions apply to the Prize, as applicable: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash, another prize or otherwise (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor's option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the potential winner, including without limitation, airline baggage fees, gratuities, meals, transportation, personal expenses of any kind or nature, federal, provincial and local taxes, room taxes and other hotel fees, charges and/or fees arising from changes, and any other incidental costs or expenses; (iv) if the potential winner (and as applicable, their guest(s)) does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor's sole and absolute discretion, a cash award; (vi) neither Sponsor nor any of its prize providers will replace any lost, stolen or destroyed tickets, gift cards, promotional cards or vouchers; (vii) any difference between the actual value of a Prize and its stated ARV will not be awarded (including, as applicable and without limitation, the point of departure and fluctuations in the cost of air transportation); (viii) Prize may not be exactly as shown in promotional materials; (ix) by accepting the Prize, the potential winner (and as applicable, their guest(s)) agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) if the Prize includes guest(s), guest(s) must be at least 19 years of age; and (xi) by participating in a Prize or any portion thereof, the potential winner (and as applicable, their guest(s)): (a) signifies that they understand, acknowledge and accept that participation in the Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that they acknowledge and agrees that the Released Parties (as defined below) have not made any warranties, guarantees or representations about their safety while participating in the Prize.
The Released Parties (as defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever), of any aspect of the Prize. Neither the potential winner (and as applicable, their guest(s)) nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The potential winner (and as applicable, their guest(s)) will be solely responsible for complying with any and all COVID related and other protocols – including, but not limited to, mandatory vaccination, testing and/or screening requirements.
None of the Released Parties (as defined below) makes any representation or offers any guarantee or warranty, express or implied, in fact or in law, as to the quality, authenticity, merchantability, mechanical condition or fitness of any prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the potential winner understands and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.
By entering this Contest and accepting the Prize, the potential winner agrees to maintain their (and as applicable, their guest(s)) behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest-related or Prize-related activity. The potential winner understands and agrees that Sponsor, or prize providers have the right, in their sole discretion, to disqualify and remove the potential winner (and as applicable, their guest(s)) from any activity at any time if the potential winner (and as applicable, theirs guest(s)) behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest-related party or otherwise violates the policies of the prize providers, and in such a case, the potential winner will still be solely responsible for all expenses related to the Prize.
- WINNER SELECTION: A random draw will be conducted from all eligible Entries submitted and received in accordance with these Rules during the Contest Period to select one (1) eligible entrant on or around May 21, 2026 (the “Selection Date”) at 1209 King Street West, Unit 200, Toronto, Ontario M6K 1G2 by the Sponsor or its designated representative(s), and such selected entrant(s) will be deemed the potential winner(s).
The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.
- WINNER NOTIFICATION PROCESS. The Sponsor or its designated representative will make a minimum of two (2) attempts to contact the potential winner (using the information provided at the time of entry) within two (2) business days of the Selection Date. If the potential winner cannot be contacted within two (2) business days of the Selection Date, or if there is a return of any notification as undeliverable; then the potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential winner. No communication will be entered into by the Sponsor with entrants except with selected entrants. The Sponsor is not responsible for the failure, for any reason whatsoever, of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response.
- WINNER CONFIRMATION PROCESS. BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by e-mail or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective successors and assigns, any provincial liquor authorities and any participating licensed establishments (collectively, the “Released Parties”) from any and all liability, directly or indirectly, in connection with this Contest, including without limitation use of the potential winner’s Contest-related information (or any portion thereof), their participation therein, the awarding, receipt, possession or use/misuse of the Prize or any portion thereof, and/or their violation or infringement of any intellectual property rights or of any publicity, personality or privacy rights, or infringe on any rights and/or interests of any third party; and (iv) agrees to the publication, reproduction and/or other use of the potential winner's name or other likeness without further notice or compensation, in perpetuity throughout the world, in any publicity or advertisement carried out by or on behalf of the Sponsor. This release shall continue in force following the termination of the Contest and/or awarding of any prize. Where applicable, potential winner’s guest(s) may also, at the discretion of the Sponsor, be required to properly execute Contest documents within the specified time as a condition of participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof.
If a potential winner: (a) fails to return the properly executed Contest documents within the specified time; (b) fails to correctly answer the skill-testing question; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (d) at any stage supplied untruthful, incomplete, inaccurate or misleading information (as determined by the Sponsor in its sole and absolute discretion); and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then the potential winner will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential winner in accordance with the winner selection procedure described above (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).
GENERAL RULES
- The provincial liquor authorities are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.
- The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Sponsor and not to Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram is completely released of all liability by each Entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Instagram.
- The Contest is governed by the laws of Canada and the Province of BC and each Entrant in the Contest hereby consents to the exclusive jurisdiction of the laws of BC for any causes or controversies arising out of the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts.
- All Entries become the property of the Sponsor. This Contest is void where prohibited and is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
- By entering this Contest, each Entrant agrees to abide by and be bound by these Rules and to save and hold harmless the Sponsor and the other Released Parties from any and all liability for harm which the potential winner may suffer as a result of participation in the Contest, compliance or non-compliance with these Rules and acceptance, use or misuse of the Prize, and each selected potential winner agrees to sign the Sponsor's declaration and release documents (see Rule 7 above) in this regard before receiving their Prize. The Released Parties shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.
- All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the accuracy and/or legitimacy of any Entry, or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.
- Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept the registration of an entry if the Sponsor considers the entry to have been submitted by an ineligible person or through the use of any automated, macro, script, robotic or other system(s) or program(s). All Entrants must prove their eligibility with valid photo identification and proof of residency, upon request.
- In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).
- Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure, and if applicable, subject to approval from any provincial liquor authority. The Sponsor, at its sole and absolute discretion reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. The Sponsor reserves the right, at its sole and absolute discretion to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
- No responsibility is assumed by the Sponsor and the other Released Parties for any inability of a potential entrant to successfully enter the contest for any reason. The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above. Without limiting the generality of the foregoing, by participating in the Contest, each entrant releases the Released Parties from any and all liability in connection with this Contest and their participation therein.
- Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
- By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with their Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://sunwelddistilling.com/privacy/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
- In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law, unless otherwise determined by the Sponsor, in its sole and absolute discretion.
- The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
- For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

RÈGLEMENT OFFICIEL DU CONCOURS
En participant au concours « Cours la chance de gagner un mini-frigo Sunweld » (le « concours »), vous confirmez avoir lu et accepté d’être légalement lié par le présent règlement officiel (le « règlement »). Les décisions de Mark Anthony Group Inc. (le « commanditaire ») – une entreprise de Colombie-Britannique, qui possède un bureau au 1209 King Street West, local 200, Toronto (Ontario) M6K 1G2 – concernant tous les aspects du concours sont définitives et exécutoires.
- PÉRIODE DU CONCOURS. Le concours débute le 14 mai 2026 à 00 h 00 min 01 s (heure de l’Est) et prend fin le 20 mai 2026 à 23 h 59 min 59 s (heure de l’Est) (la « période du concours »). Les participations soumises avant ou après la période du concours ne seront pas admissibles. Le parc informatique ou l’équipement réseau du commanditaire est l’appareil de chronométrage officiel du concours.
- ADMISSIBILITÉ. Pour participer au concours et avoir la chance de gagner un prix, une personne (le « participant ») doit être un résident autorisé du Canada et avoir atteint l’âge légal de consommation d’alcool dans sa province ou son territoire de résidence au moment de sa participation. Sont exclus du concours : (a) les employés, administrateurs, représentants, mandataires ou dirigeants du commanditaire, de ses sociétés mères, filiales, sociétés affiliées, agences de publicité ou de promotion, fournisseurs de prix, et toute autre personne ou entité impliquée dans le développement, la production, l’administration ou l’exécution du concours (collectivement, les « parties au concours »); (b) les employés et agents contractuels des régies des alcools provinciales et des établissements licenciés participants; et (c) les membres de la famille immédiate (c.-à-d. les parents, les frères et sœurs, les enfants, le conjoint ou le partenaire de vie, peu importe leur lieu de résidence) ou du ménage (qu’il y ait un lien de parenté ou non) des personnes susmentionnées.
- COMMENT PARTICIPER? Aucun achat requis. Un achat n’augmente pas les chances de gagner. Un accès Internet et un compte Instagram actif sont requis. La participation se fait uniquement en ligne sur Instagram; aucun autre moyen de participation ne sera accepté.

- Dans les commentaires de la publication du concours, ajouter le mot-clic #ContestEntry et identifier au moins un (1) ami âgé d’au moins 19 ans.
Lorsque le participant aura effectué toutes les étapes susmentionnées (tel que déterminé par le commanditaire à sa seule discrétion), il sera admissible à une participation (une « participation »).

Une participation peut être rejetée si (à l’entière discrétion du commanditaire) : (i) elle n’est pas soumise et reçue conformément au présent règlement ou aux règles d’Instagram pendant la période du concours; ou (ii) elle n’est pas, d’une quelconque manière, conforme au présent règlement ou aux règles d’Instagram (tel que déterminé par le commanditaire à sa seule discrétion).
Des frais de messagerie et de données standards peuvent s’appliquer si le participant choisit de s’inscrire sur un appareil mobile ou tout autre appareil électronique. Il incombe au participant de contacter son fournisseur de services pour s’informer des tarifs et plans de service avant de s’inscrire à l’aide d’un appareil mobile ou électronique.
- PRIX. Le prix ne comporte pas d’alcool. Il y a un (1) prix à gagner (le « prix »). Le prix consiste en un mini-réfrigérateur avec le logo Sunweld. Le prix est fourni par le commanditaire. La valeur au détail approximative (VDA) du prix est de deux cent cinquante dollars canadiens (250 $ CA).
Il y a une limite d’un (1) prix par personne. Le nombre de prix attribué ne dépassera pas le nombre indiqué. Le prix sera attribué uniquement au gagnant dont l’identité aura été vérifiée. Les modalités de livraison du prix seront confirmées avec le gagnant potentiel par courriel, par téléphone ou par Instagram (message privé ou publication avec identification). Si un prix ou un avis de prix est retourné avec une mention d’échec de livraison, le participant sélectionné pourrait être disqualifié et, le cas échéant, un autre gagnant pourrait être choisi.
Sans limiter ce qui précède, les modalités suivantes s’appliquent au prix, le cas échéant : (i) le prix doit être accepté tel qu’il est attribué, sans possibilité de transfert, de cession ou d’échange contre de l’argent comptant, un autre prix ou toute autre compensation (à moins d’autorisation spéciale du commanditaire, à sa seule discrétion); (ii) aucune substitution ne sera permise, sauf à la discrétion du commanditaire; (iii) tous les frais qui ne sont pas spécifiquement et expressément mentionnés ci-dessus comme faisant partie du prix sont à la charge du gagnant potentiel, y compris, sans s’y limiter, les frais de bagages des compagnies aériennes, les pourboires, les repas, le transport, les dépenses personnelles de toute nature, les taxes fédérales, provinciales et locales, les taxes d’hébergement et autres frais hôteliers, les frais découlant de modifications et tout autres frais ou dépenses accessoires; (iv) si le gagnant potentiel n’utilise pas (ainsi que son ou ses invités, le cas échéant) un ou plusieurs éléments du prix, ces derniers peuvent être annulés dans leur intégralité, à la seule discrétion du commanditaire, auquel cas il n’y aura aucune substitution; (v) le commanditaire se réserve le droit, à tout moment : (a) d’imposer des restrictions raisonnables quant à la disponibilité ou à l’utilisation du prix ou de l’un de ses éléments; et (b) de substituer le prix ou l’un de ses éléments, pour quelque raison que ce soit, par un prix ou un ou plusieurs éléments de prix d’une valeur au détail égale ou supérieure, y compris, sans s’y limiter, à la seule discrétion du commanditaire, une somme en argent; (vi) ni le commanditaire ni aucun des fournisseurs de prix ne remplaceront les billets, cartes-cadeaux, cartes promotionnelles ou bons perdus, volés ou détruits; (vii) aucune compensation ne sera offerte si la valeur réelle du prix diffère de sa valeur au détail approximative indiquée (notamment en raison du point de départ ou des fluctuations du coût du transport aérien); (viii) le prix peut différer de l’illustration présentée dans le matériel promotionnel; (ix) en acceptant le prix, le gagnant potentiel renonce (ainsi que son ou ses invités, le cas échéant) à tout recours contre le commanditaire et les autres parties exonérées si le prix ou l’un de ses éléments s’avère insatisfaisant, en tout ou en partie; (x) si le prix comprend un ou plusieurs invités, ceux-ci doivent être âgés d’au moins 19 ans; et (xi) en participant à un prix ou à l’un de ses éléments, le gagnant potentiel (ainsi que chaque invité, le cas échéant) : (a) comprend, reconnaît et accepte que sa participation au prix peut comporter des dangers et une exposition à des risques ou à des dangers (y compris, sans s’y limiter, les risques inhérents aux voyages et les risques liés à une exposition ou une infection potentielle à la COVID-19), résultant d’une erreur humaine ou de négligence prévisibles ou non, et qu’il pourrait subir des dommages matériels, des blessures graves, une maladie ou même le décès; (b) reconnaît et accepte que les parties exonérées (telles que définies ci-dessous) n’ont émis aucune garantie, promesse, ni déclaration concernant sa sécurité pendant sa participation au prix.
Les parties exonérées (telles que définies ci-dessous) ne sont pas responsables du retard, du report, de la suspension, de la reprogrammation ou de l’annulation, pour quelque raison que ce soit (y compris, sans s’y limiter, en raison d’une maladie ou de risques pour la santé, ou de toute ordonnance, mesure, directive ou orientation du gouvernement ou des autorités sanitaires en réponse à une telle maladie ou à de tels risques comme, sans s’y limiter, celles qui peuvent être mises en œuvre pour atténuer la transmission de la COVID-19, ou en raison de toute autre cause de quelque nature que ce soit), de tout aspect du prix. Ni le gagnant potentiel (et, le cas échéant, son ou ses invités) ni aucune autre personne ou entité ne seront dédommagés en cas de retard, d’annulation ou de tout autre événement envisagé dans le présent règlement. Le gagnant potentiel et son ou ses invités, le cas échéant, seront seuls responsables du respect de tous les protocoles liés à la COVID et autres, y compris, sans s’y limiter, les vaccinations obligatoires, les tests et les exigences de dépistage.
Aucune des parties exonérées (telles que définies ci-dessous) ne fait de déclaration ni n’offre de garantie, expresse ou tacite, de fait ou de droit, quant à la qualité, l’authenticité, la qualité marchande, l’état mécanique et l’adéquation à un usage particulier du prix attribué dans le cadre du concours. Dans toute la mesure permise par la loi applicable, le gagnant potentiel comprend et reconnaît qu’il ne peut pas demander de remboursement ou exercer un recours légal ou en equity auprès du commanditaire ou de l’une des autres parties exonérées si le prix n’est pas adapté à un usage particulier ou s’il est insatisfaisant de quelque manière que ce soit.
En participant à ce concours et en acceptant le prix, le gagnant potentiel convient d’adopter, ainsi que son ou ses invités, le cas échéant, un comportement conforme à toutes les lois applicables et des pratiques sociales généralement acceptées lors de sa participation à toute activité associée au concours ou au prix. Le gagnant potentiel comprend et accepte que le commanditaire (ou un fournisseur de prix) a le droit, à sa seule discrétion, de disqualifier et de retirer le gagnant potentiel ou son ou ses invités de toute activité, en tout temps, si le comportement du gagnant potentiel ou de son ou ses invités est à tout moment récalcitrant ou dérangeant, ou s’il peut causer ou a causé des blessures, des dommages, ou s’il peut nuire ou a nui à la réputation de toute partie liée au concours ou s’il enfreint de quelque façon que ce soit les politiques des fournisseurs de prix. Dans un tel cas, tous les frais liés au prix resteront entièrement à la charge du gagnant potentiel.
- SÉLECTION DES GAGNANTS. Un tirage au sort sera effectué parmi toutes les participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours afin de sélectionner une (1) participation admissible le ou vers le 21 mai 2026 (la « date de sélection ») au 1209 King Street West, local 200, Toronto (Ontario) M6K 1G2 par le commanditaire ou ses représentants désignés, et ce participant sélectionné sera réputé être le gagnant potentiel.
Les chances de gagner dépendent du nombre de participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours.
- PROCESSUS DE NOTIFICATION DU GAGNANT. Le commanditaire ou son représentant désigné effectuera un minimum de deux (2) tentatives pour contacter le gagnant potentiel (à l’aide des renseignements fournis au moment de la participation) dans les deux (2) jours ouvrables suivant la date de sélection. S’il s’avère impossible de joindre le gagnant potentiel dans les deux (2) jours ouvrables suivant la date de sélection ou si un avis est retourné avec une mention d’échec de livraison, le gagnant potentiel sera alors disqualifié, à la seule discrétion du commanditaire (et, étant disqualifié, il perdra tous ses droits liés au prix), et le commanditaire se réserve le droit, à sa seule discrétion et si le temps le permet, de sélectionner un autre gagnant potentiel en fonction du même processus de sélection du gagnant décrit ci-dessus (avec les modifications nécessaires), et dans un tel cas, les dispositions précédentes de la présente section s’appliqueront au nouveau gagnant potentiel. Le commanditaire ne communiquera pas avec les participants, sauf avec les participants sélectionnés. Le commanditaire ne peut être tenu responsable dans l’éventualité où un participant sélectionné ne recevrait pas l’avis ou que sa réponse ne lui parviendrait pas.
- PROCESSUS DE CONFIRMATION DU GAGNANT. AVANT D’ÊTRE DÉCLARÉ GAGNANT CONFIRMÉ DU PRIX, le gagnant potentiel devra : (a) répondre correctement, sans aide mécanique ou autre, à une question réglementaire d’arithmétique (laquelle pourra, à la seule discrétion du commanditaire, être administrée en ligne, par courriel ou autre moyen électronique, par téléphone ou dans le formulaire de déclaration de conformité et d’exonération de responsabilité du commanditaire); et (b) signer et retourner, dans les deux (2) jours ouvrables suivant la notification, le formulaire de déclaration de conformité et d’exonération de responsabilité du commanditaire, lequel (entre autres) : (i) confirme le respect du présent règlement; (ii) confirme l’acceptation du prix tel qu’attribué; (iii) libère les parties ainsi que leurs successeurs et ayants droit respectifs, les régies des alcools provinciales et les établissements licenciés participants (collectivement, les « parties exonérées ») de toute responsabilité, directe ou indirecte, liée au concours, y compris, sans s’y limiter, à l’utilisation des renseignements fournis par le gagnant potentiel dans le cadre du concours (en tout ou en partie), à sa participation au concours, à l’attribution, à la réception, à la possession, à l’utilisation ou à la mauvaise utilisation du prix (ou de toute portion de celui-ci), ou à l’atteinte à des droits de propriété intellectuelle, à des droits à l’image, à des droits à la vie privée ou à tout autre droit ou intérêt d’un tiers, y compris ceux relatifs à la publicité ou à la personnalité; et (iv) accepte la publication, la reproduction et toute autre utilisation de son nom ou de son image, sans autre avis ni compensation, à perpétuité dans le monde entier, dans toute publicité ou annonce réalisée par le commanditaire ou en son nom. Cette exonération restera en vigueur après la fin du concours et de l’attribution du prix. Le cas échéant, le ou les invités du gagnant potentiel peuvent également, à la discrétion du commanditaire, être tenus de signer dûment les documents du concours dans le délai imparti, à titre de condition de participation à un prix ou à une portion de celui-ci. Cette exonération restera en vigueur après la fin du concours et/ou la participation du ou des invités au prix ou à une portion de celui-ci.
Si un gagnant potentiel : (a) ne retourne pas les documents du concours dûment signés dans le délai imparti; (b) ne répond pas correctement à la question réglementaire; (c) ne peut pas accepter (ou ne veut pas accepter) le prix (tel qu’il est attribué) pour quelque raison que ce soit; (d) a, à quelque étape que ce soit, fourni des renseignements faux, incomplets, inexacts ou trompeurs (tels que déterminés par le commanditaire, à sa seule discrétion); ou (e) est considéré comme étant en infraction au présent règlement (le tout tel que déterminé par le commanditaire à sa seule discrétion), il sera disqualifié (et perdra tous ses droits au prix) et le commanditaire se réserve le droit, à sa seule discrétion et si le temps le permet, de sélectionner au hasard un autre gagnant potentiel conformément aux modalités de sélection des gagnants décrites ci-dessus (auquel cas les dispositions précédentes de cette section s’appliqueront à ce nouveau gagnant potentiel sélectionné).
DISPOSITIONS GÉNÉRALES
- Les régies des alcools provinciales ne sont aucunement associées au concours ni responsables de toute question relative au concours.
- Le concours n’est en aucun cas parrainé, approuvé ou administré par Instagram, pas plus qu’il n’y est associé. Le participant convient qu’il fournit ses renseignements au commanditaire, et non à Instagram. Les renseignements fournis ne seront utilisés que pour administrer le concours conformément à la politique de protection de la vie privée du commanditaire. Le participant au concours dégage entièrement Instagram de toute responsabilité. Toute question, remarque ou plainte concernant le concours doit être adressée au commanditaire, et non à Instagram.
- Le concours est régi par les lois du Canada et de la province de la Colombie-Britannique, et le participant accepte par la présente la juridiction exclusive des lois de la Colombie-Britannique pour les causes ou litiges découlant du concours. Le participant renonce à toute objection concernant la juridiction et la compétence de ces tribunaux.
- Toutes les participations deviennent la propriété du commanditaire. Le concours est nul là où la loi l’interdit et assujetti à toutes les lois fédérales, provinciales et municipales applicables. Les décisions du commanditaire concernant tous les aspects du concours sont définitives et exécutoires pour tous les participants, sans droit de recours, y compris, sans s’y limiter, toute décision concernant l’admissibilité/la disqualification des participations et des participants. TOUTE PERSONNE QUE LE COMMANDITAIRE CONSIDÈRE, POUR QUELQUE RAISON QUE CE SOIT, COMME ÉTANT EN CONTRAVENTION AVEC LE PRÉSENT RÈGLEMENT POURRA ÊTRE DISQUALIFIÉE À TOUT MOMENT, À LA SEULE DISCRÉTION DU COMMANDITAIRE.
- En s’inscrivant au concours, chaque participant accepte de se conformer au présent règlement et de dégager le commanditaire et les autres parties exonérées de toute responsabilité en cas de préjudice au gagnant potentiel découlant de la participation au concours, du respect ou non-respect du présent règlement et de l’acceptation, de l’utilisation ou de la mauvaise utilisation du prix, et chaque gagnant potentiel sélectionné accepte de signer la déclaration de conformité et d’exonération de responsabilité du commanditaire (voir l’article 7 ci-dessus) à cet égard avant de recevoir son prix. Les parties exonérées se dégagent de toute responsabilité se rattachant au concours ou au prix attribué.
- Toutes les participations peuvent faire l’objet d’une vérification en tout temps et pour toute raison. Le commanditaire se réserve le droit, à sa seule discrétion, d’exiger une preuve d’identité et/ou d’admissibilité (sous une forme acceptable pour le commanditaire – y compris, sans s’y limiter, une pièce d’identité avec photo émise par le gouvernement) : (i) dans le but de vérifier l’admissibilité d’une personne à participer à ce concours; (ii) dans le but de vérifier l’admissibilité ou la légitimité d’une participation ou de toute autre information soumise (ou prétendument soumise) aux fins du concours; ou (iii) pour toute autre raison que le commanditaire juge nécessaire, à sa seule discrétion, dans le but d’administrer le concours conformément à la lettre et à l’esprit du présent règlement. Le fait de ne pas fournir dans le délai imparti une telle preuve à l’entière satisfaction du commanditaire peut entraîner la disqualification du participant, à la seule discrétion du commanditaire.
- Il est interdit de donner ou de vendre des participations, et le commanditaire se réserve le droit de refuser une participation s’il considère qu’elle a été soumise par une personne inadmissible ou au moyen d’un système ou programme automatisé, robotisé, généré par macro-instruction, par script ou autre. Le participant doit prouver son admissibilité à l’aide d’une pièce d’identité avec photo valide et d’une preuve de résidence, sur demande.
- En cas de litige concernant l’identité de la personne ayant soumis une participation, le commanditaire se réserve le droit, à sa seule discrétion, d’exiger que toute personne prétendant être à l’origine de ladite participation fournisse la preuve, à l’entière satisfaction du commanditaire (à sa seule discrétion), qu’elle est bien l’auteur de la participation en question. Le fait de ne pas fournir dans le délai imparti une telle preuve à l’entière satisfaction du commanditaire peut entraîner la disqualification du participant (tel que déterminé par le commanditaire à sa seule discrétion).
- Le commanditaire se réserve le droit, à sa seule discrétion, de retirer, de modifier ou de suspendre le concours (ou de modifier le présent règlement) de quelque manière que ce soit, en cas de cause indépendante du contrôle raisonnable du commanditaire qui contreviendrait au bon déroulement du concours, tel qu’il est décrit dans le présent règlement, y compris, sans s’y limiter, une erreur, un problème technique, un virus informatique, un bogue, un trafiquage, une intervention non autorisée, une fraude ou une défaillance technique, et, le cas échéant, sous réserve de l’approbation d’une régie des alcools provinciale. Le commanditaire, à sa seule discrétion, se réserve le droit d’annuler, de modifier ou de suspendre le concours, ou de modifier le présent règlement, de quelque manière que ce soit, sans préavis ni obligation, en cas d’accident, d’erreur d’impression, d’erreur administrative ou autre, ou pour toute autre raison que ce soit. Sans limiter la portée générale de ce qui précède, le commanditaire se réserve le droit, à sa seule discrétion, d’administrer une autre épreuve réglementaire s’il le juge approprié en fonction des circonstances ou afin de se conformer à la législation applicable. Le commanditaire se réserve le droit, à sa seule discrétion, d’ajuster les dates, les périodes et/ou les autres modalités du concours prévues dans le présent règlement, dans la mesure nécessaire, afin de vérifier la conformité d’un participant ou d’une participation au présent règlement, ou en raison de problèmes techniques ou autres, ou en considération de toute autre circonstance qui, de l’avis du commanditaire, à sa seule discrétion, compromet la bonne administration du concours, telle qu’elle est décrite dans le présent règlement, ou pour toute autre raison.
- Le commanditaire et les autres parties exonérées n’assument aucune responsabilité en cas d’incapacité d’un participant potentiel à s’inscrire au concours pour quelque raison que ce soit. Les parties exonérées ne seront pas responsables : (i) de toute défaillance d’un site Web pendant le concours; (ii) de tout dysfonctionnement technique ou autre problème de quelque nature que ce soit, y compris, sans s’y limiter, ceux liés au réseau ou aux lignes téléphoniques, aux systèmes informatiques en ligne, aux serveurs, aux fournisseurs d’accès, au matériel informatique ou aux logiciels; (iii) de l’impossibilité de recevoir, de saisir ou d’enregistrer une participation ou toute autre information, pour quelque raison que ce soit, y compris, sans s’y limiter, les problèmes techniques ou la saturation du réseau Internet ou d’un site Web; (iv) de tout dommage ou préjudice subi par l’ordinateur ou tout autre appareil d’un participant ou d’une autre personne, en lien avec la participation au concours ou résultant de celle-ci; et (v) de toute combinaison des éléments ci-dessus. Sans limiter la portée générale de ce qui précède, en s’inscrivant au concours, chaque participant accepte de dégager les parties exonérées de toute responsabilité en lien avec le concours et sa participation.
- Toute tentative délibérée d’endommager un site Web ou de saboter le déroulement légitime du concours de quelque manière que ce soit (tel que déterminé par le commanditaire à sa seule discrétion) constitue une infraction civile et pénale, et le commanditaire se réserve le droit d’intenter une poursuite en dommages-intérêts dans la mesure où la loi le permet.
- En s’inscrivant à ce concours, chaque participant consent expressément à ce que le commanditaire, ses mandataires ou ses représentants conservent, partagent et utilisent les renseignements personnels soumis avec sa participation uniquement aux fins de l’administration du concours et conformément à la politique de confidentialité du commanditaire (qui se trouve à https://sunwelddistilling.com/privacy/). La présente section ne limite aucun autre consentement que la personne concernée pourrait accorder au commanditaire ou à toute autre partie en ce qui a trait à la collecte, l’utilisation et la divulgation de ses renseignements personnels.
- En cas de divergence ou de contradiction entre le présent règlement et les communications ou autres déclarations contenues dans tout matériel lié au concours, y compris, sans s’y limiter, les publicités diffusées sur le site Web, dans les points de vente, à la télévision, en format papier ou en ligne ou toute instruction ou interprétation relative au présent règlement de la part d’un représentant du commanditaire, les modalités du présent règlement prévaudront, régiront et auront préséance dans toute la mesure permise par la loi, à moins que le commanditaire n’en décide autrement, à sa seule discrétion.
- La nullité ou l’inapplicabilité d’une disposition du présent règlement ne pourra compromettre la validité ni la force exécutoire des autres dispositions. Si une disposition du règlement est déclarée non valide ou autrement inapplicable ou illégale, le présent règlement reste en vigueur et doit être interprété selon ses modalités comme si la disposition non valide ou illégale n’en faisait pas partie.
- Pour les résidents du Québec : Un différend quant à l’organisation ou à la conduite d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux afin qu’il soit tranché. Un différend quant à l’attribution d’un prix peut être soumis à la Régie uniquement aux fins d’une intervention pour tenter de le régler.

OFFICIAL CONTEST RULES AND REGULATIONS
By participating in the “Enter for a Chance to Win a Sunweld Mini Fridge” Contest (the “Contest”), you are signifying your agreement that you have read and agree to be legally bound by these official contest rules and regulations (the “Rules”). The decisions of Mark Anthony Group Inc., a BC company, (the “Sponsor”) with an office at 1209 King Street West, Unit 200, Toronto, Ontario M6K 1G2, with respect to all aspects of the Contest are final and binding.
- CONTEST PERIOD. The Contest begins at 12:00:01 am Eastern Time (“ET”) on May 14, 2026 and ends at 11:59:59 pm ET on May 20, 2026 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or networking equipment is the official time-keeping device for the Contest.
- ELIGIBILITY. To enter the Contest and be eligible for a chance to win a prize a person (the “Entrant”) must be a legal resident of Canada who have reached the legal drinking age in their province or territory of residence at the time of entry. Once you have completed all of the foregoing steps to enter (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive an entry (an “Entry”).
Entries: To be eligible, all entry elements associated with your Entry and/or the Entrant’s account must: (i) be publicly shared; (ii) not be deleted or altered during the Contest Period; (iii) be submitted and received in accordance with these Rules during the Contest Period; (iv) includes all required components/elements required in Rule 3; (v) be in accordance and compliant with these Rules; and (vi) be in accordance and compliant with the applicable terms, rules, policies and guidelines of Instagram (the “Instagram Rules”).

If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses, and/or Instagram accounts; (iii) use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; and/or (iv) disrupt or participate in the Contest in any other fraudulent, abusive, deceptive, unfair or misleading way; then the Entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Entry is not submitted and received in accordance with these Rules or Instagram Rules during the Contest Period; and/or (ii) the Entry is not otherwise in compliance with these Rules or Instagram Rules (all as determined by Sponsor in its sole and absolute discretion).
Standard message and data rates may apply to participants who choose to participate in the Contest through a mobile device or other electronic devices. Please contact your service provider for pricing and service plan information and rates before any mobile or electronic device participation.
- PRIZE. Alcohol is not part of the prize. There will be one (1) Prize (the “Prize”). The Prize consists of: Sunweld Branded Mini Fridge. The Prize is provided by the Sponsor. The approximate retail value (“ARV”) of the Prize is two hundred fifty Canadian dollars ($250 CAD).
There is a limit of one (1) Prize per person. No more than the advertised number of prizes will be awarded. The Prize will only be released to the verified winner. Arrangements for Prize delivery will be confirmed with the potential winner by e-mail, telephone or Instagram (direct message or tagged post). Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.
Without limiting the foregoing, the following terms and conditions apply to the Prize, as applicable: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash, another prize or otherwise (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor's option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the potential winner, including without limitation, airline baggage fees, gratuities, meals, transportation, personal expenses of any kind or nature, federal, provincial and local taxes, room taxes and other hotel fees, charges and/or fees arising from changes, and any other incidental costs or expenses; (iv) if the potential winner (and as applicable, their guest(s)) does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor's sole and absolute discretion, a cash award; (vi) neither Sponsor nor any of its prize providers will replace any lost, stolen or destroyed tickets, gift cards, promotional cards or vouchers; (vii) any difference between the actual value of a Prize and its stated ARV will not be awarded (including, as applicable and without limitation, the point of departure and fluctuations in the cost of air transportation); (viii) Prize may not be exactly as shown in promotional materials; (ix) by accepting the Prize, the potential winner (and as applicable, their guest(s)) agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) if the Prize includes guest(s), guest(s) must be at least 19 years of age; and (xi) by participating in a Prize or any portion thereof, the potential winner (and as applicable, their guest(s)): (a) signifies that they understand, acknowledge and accept that participation in the Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that they acknowledge and agrees that the Released Parties (as defined below) have not made any warranties, guarantees or representations about their safety while participating in the Prize.
The Released Parties (as defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever), of any aspect of the Prize. Neither the potential winner (and as applicable, their guest(s)) nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The potential winner (and as applicable, their guest(s)) will be solely responsible for complying with any and all COVID related and other protocols – including, but not limited to, mandatory vaccination, testing and/or screening requirements.
None of the Released Parties (as defined below) makes any representation or offers any guarantee or warranty, express or implied, in fact or in law, as to the quality, authenticity, merchantability, mechanical condition or fitness of any prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the potential winner understands and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.
By entering this Contest and accepting the Prize, the potential winner agrees to maintain their (and as applicable, their guest(s)) behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest-related or Prize-related activity. The potential winner understands and agrees that Sponsor, or prize providers have the right, in their sole discretion, to disqualify and remove the potential winner (and as applicable, their guest(s)) from any activity at any time if the potential winner (and as applicable, theirs guest(s)) behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest-related party or otherwise violates the policies of the prize providers, and in such a case, the potential winner will still be solely responsible for all expenses related to the Prize.
- WINNER SELECTION: A random draw will be conducted from all eligible Entries submitted and received in accordance with these Rules during the Contest Period to select one (1) eligible entrant on or around May 21, 2026 (the “Selection Date”) at 1209 King Street West, Unit 200, Toronto, Ontario M6K 1G2 by the Sponsor or its designated representative(s), and such selected entrant(s) will be deemed the potential winner(s).
The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.
- WINNER NOTIFICATION PROCESS. The Sponsor or its designated representative will make a minimum of two (2) attempts to contact the potential winner (using the information provided at the time of entry) within two (2) business days of the Selection Date. If the potential winner cannot be contacted within two (2) business days of the Selection Date, or if there is a return of any notification as undeliverable; then the potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential winner. No communication will be entered into by the Sponsor with entrants except with selected entrants. The Sponsor is not responsible for the failure, for any reason whatsoever, of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response.
- WINNER CONFIRMATION PROCESS. BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by e-mail or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective successors and assigns, any provincial liquor authorities and any participating licensed establishments (collectively, the “Released Parties”) from any and all liability, directly or indirectly, in connection with this Contest, including without limitation use of the potential winner’s Contest-related information (or any portion thereof), their participation therein, the awarding, receipt, possession or use/misuse of the Prize or any portion thereof, and/or their violation or infringement of any intellectual property rights or of any publicity, personality or privacy rights, or infringe on any rights and/or interests of any third party; and (iv) agrees to the publication, reproduction and/or other use of the potential winner's name or other likeness without further notice or compensation, in perpetuity throughout the world, in any publicity or advertisement carried out by or on behalf of the Sponsor. This release shall continue in force following the termination of the Contest and/or awarding of any prize. Where applicable, potential winner’s guest(s) may also, at the discretion of the Sponsor, be required to properly execute Contest documents within the specified time as a condition of participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof.
If a potential winner: (a) fails to return the properly executed Contest documents within the specified time; (b) fails to correctly answer the skill-testing question; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (d) at any stage supplied untruthful, incomplete, inaccurate or misleading information (as determined by the Sponsor in its sole and absolute discretion); and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then the potential winner will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential winner in accordance with the winner selection procedure described above (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).
GENERAL RULES
- The provincial liquor authorities are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.
- The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Sponsor and not to Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram is completely released of all liability by each Entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Instagram.
- The Contest is governed by the laws of Canada and the Province of BC and each Entrant in the Contest hereby consents to the exclusive jurisdiction of the laws of BC for any causes or controversies arising out of the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts.
- All Entries become the property of the Sponsor. This Contest is void where prohibited and is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
- By entering this Contest, each Entrant agrees to abide by and be bound by these Rules and to save and hold harmless the Sponsor and the other Released Parties from any and all liability for harm which the potential winner may suffer as a result of participation in the Contest, compliance or non-compliance with these Rules and acceptance, use or misuse of the Prize, and each selected potential winner agrees to sign the Sponsor's declaration and release documents (see Rule 7 above) in this regard before receiving their Prize. The Released Parties shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.
- All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the accuracy and/or legitimacy of any Entry, or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.
- Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept the registration of an entry if the Sponsor considers the entry to have been submitted by an ineligible person or through the use of any automated, macro, script, robotic or other system(s) or program(s). All Entrants must prove their eligibility with valid photo identification and proof of residency, upon request.
- In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).
- Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure, and if applicable, subject to approval from any provincial liquor authority. The Sponsor, at its sole and absolute discretion reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. The Sponsor reserves the right, at its sole and absolute discretion to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
- No responsibility is assumed by the Sponsor and the other Released Parties for any inability of a potential entrant to successfully enter the contest for any reason. The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above. Without limiting the generality of the foregoing, by participating in the Contest, each entrant releases the Released Parties from any and all liability in connection with this Contest and their participation therein.
- Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
- By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with their Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://sunwelddistilling.com/privacy/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
- In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law, unless otherwise determined by the Sponsor, in its sole and absolute discretion.
- The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
- For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

RÈGLEMENT OFFICIEL DU CONCOURS
En participant au concours « Cours la chance de gagner un mini-frigo Sunweld » (le « concours »), vous confirmez avoir lu et accepté d’être légalement lié par le présent règlement officiel (le « règlement »). Les décisions de Mark Anthony Group Inc. (le « commanditaire ») – une entreprise de Colombie-Britannique, qui possède un bureau au 1209 King Street West, local 200, Toronto (Ontario) M6K 1G2 – concernant tous les aspects du concours sont définitives et exécutoires.
- PÉRIODE DU CONCOURS. Le concours débute le 14 mai 2026 à 00 h 00 min 01 s (heure de l’Est) et prend fin le 20 mai 2026 à 23 h 59 min 59 s (heure de l’Est) (la « période du concours »). Les participations soumises avant ou après la période du concours ne seront pas admissibles. Le parc informatique ou l’équipement réseau du commanditaire est l’appareil de chronométrage officiel du concours.
- ADMISSIBILITÉ. Pour participer au concours et avoir la chance de gagner un prix, une personne (le « participant ») doit être un résident autorisé du Canada et avoir atteint l’âge légal de consommation d’alcool dans sa province ou son territoire de résidence au moment de sa participation. Sont exclus du concours : (a) les employés, administrateurs, représentants, mandataires ou dirigeants du commanditaire, de ses sociétés mères, filiales, sociétés affiliées, agences de publicité ou de promotion, fournisseurs de prix, et toute autre personne ou entité impliquée dans le développement, la production, l’administration ou l’exécution du concours (collectivement, les « parties au concours »); (b) les employés et agents contractuels des régies des alcools provinciales et des établissements licenciés participants; et (c) les membres de la famille immédiate (c.-à-d. les parents, les frères et sœurs, les enfants, le conjoint ou le partenaire de vie, peu importe leur lieu de résidence) ou du ménage (qu’il y ait un lien de parenté ou non) des personnes susmentionnées.
- COMMENT PARTICIPER? Aucun achat requis. Un achat n’augmente pas les chances de gagner. Un accès Internet et un compte Instagram actif sont requis. La participation se fait uniquement en ligne sur Instagram; aucun autre moyen de participation ne sera accepté.
Pour participer sur Instagram :
- Au début ou vers le début de la période du concours, le commanditaire ou son représentant désigné fera une (1) publication en lien avec le concours (la « publication du concours ») sur www.instagram.com/sunwelddistilling (la « page Instagram du concours »).
- Pour s’inscrire, le participant doit accéder à son compte Instagram (ou créer un compte au www.instagram.com), visiter la page Instagram du concours pendant la période du concours, repérer la publication du concours et faire les étapes suivantes :
- Aimer la publication du concours.
- Suivre la page de Sunweld Distilling (@sunwelddistilling).
- Dans les commentaires de la publication du concours, ajouter le mot-clic #ContestEntry et identifier au moins un (1) ami âgé d’au moins 19 ans.
Lorsque le participant aura effectué toutes les étapes susmentionnées (tel que déterminé par le commanditaire à sa seule discrétion), il sera admissible à une participation (une « participation »).
Participations : Pour qu’une participation soit admissible, tous les éléments connexes (en lien avec la participation ou le compte du participant) doivent : (i) être partagés publiquement; (ii) ne pas être supprimés ou modifiés pendant la période du concours; (iii) être soumis et reçus conformément au présent règlement pendant la période du concours; (iv) inclure toutes les étapes mentionnées à l’article 3; (v) être conformes au présent règlement; et (vi) être conformes aux conditions, règles, politiques et lignes directrices applicables d’Instagram (les « règles d’Instagram »).

Chaque commentaire compte pour une (1) participation, peu importe le nombre d’amis identifiés. Un seul (1) ami identifié par commentaire sera pris en compte. Le participant pourra être disqualifié du concours, à la seule discrétion du commanditaire, si ce dernier découvre (à l’aide d’une preuve ou d’une information mise à sa disposition ou autrement) qu’une personne a tenté : (i) de dépasser l’une ou l’autre des limites prévues dans le présent règlement; (ii) d’utiliser plusieurs noms, identités, adresses électroniques ou comptes Instagram; (iii) d’utiliser tout système ou programme automatisé, robotisé, généré par macro-instruction, par script ou autre pour s’inscrire ou autrement participer au concours ou le perturber; ou (iv) de perturber ou de participer au concours de manière frauduleuse, abusive, trompeuse, déloyale ou mensongère. Une participation peut être rejetée si (à l’entière discrétion du commanditaire) : (i) elle n’est pas soumise et reçue conformément au présent règlement ou aux règles d’Instagram pendant la période du concours; ou (ii) elle n’est pas, d’une quelconque manière, conforme au présent règlement ou aux règles d’Instagram (tel que déterminé par le commanditaire à sa seule discrétion).
Des frais de messagerie et de données standards peuvent s’appliquer si le participant choisit de s’inscrire sur un appareil mobile ou tout autre appareil électronique. Il incombe au participant de contacter son fournisseur de services pour s’informer des tarifs et plans de service avant de s’inscrire à l’aide d’un appareil mobile ou électronique.
- PRIX. Le prix ne comporte pas d’alcool. Il y a un (1) prix à gagner (le « prix »). Le prix consiste en un mini-réfrigérateur avec le logo Sunweld. Le prix est fourni par le commanditaire. La valeur au détail approximative (VDA) du prix est de deux cent cinquante dollars canadiens (250 $ CA).
Il y a une limite d’un (1) prix par personne. Le nombre de prix attribué ne dépassera pas le nombre indiqué. Le prix sera attribué uniquement au gagnant dont l’identité aura été vérifiée. Les modalités de livraison du prix seront confirmées avec le gagnant potentiel par courriel, par téléphone ou par Instagram (message privé ou publication avec identification). Si un prix ou un avis de prix est retourné avec une mention d’échec de livraison, le participant sélectionné pourrait être disqualifié et, le cas échéant, un autre gagnant pourrait être choisi.
Sans limiter ce qui précède, les modalités suivantes s’appliquent au prix, le cas échéant : (i) le prix doit être accepté tel qu’il est attribué, sans possibilité de transfert, de cession ou d’échange contre de l’argent comptant, un autre prix ou toute autre compensation (à moins d’autorisation spéciale du commanditaire, à sa seule discrétion); (ii) aucune substitution ne sera permise, sauf à la discrétion du commanditaire; (iii) tous les frais qui ne sont pas spécifiquement et expressément mentionnés ci-dessus comme faisant partie du prix sont à la charge du gagnant potentiel, y compris, sans s’y limiter, les frais de bagages des compagnies aériennes, les pourboires, les repas, le transport, les dépenses personnelles de toute nature, les taxes fédérales, provinciales et locales, les taxes d’hébergement et autres frais hôteliers, les frais découlant de modifications et tout autres frais ou dépenses accessoires; (iv) si le gagnant potentiel n’utilise pas (ainsi que son ou ses invités, le cas échéant) un ou plusieurs éléments du prix, ces derniers peuvent être annulés dans leur intégralité, à la seule discrétion du commanditaire, auquel cas il n’y aura aucune substitution; (v) le commanditaire se réserve le droit, à tout moment : (a) d’imposer des restrictions raisonnables quant à la disponibilité ou à l’utilisation du prix ou de l’un de ses éléments; et (b) de substituer le prix ou l’un de ses éléments, pour quelque raison que ce soit, par un prix ou un ou plusieurs éléments de prix d’une valeur au détail égale ou supérieure, y compris, sans s’y limiter, à la seule discrétion du commanditaire, une somme en argent; (vi) ni le commanditaire ni aucun des fournisseurs de prix ne remplaceront les billets, cartes-cadeaux, cartes promotionnelles ou bons perdus, volés ou détruits; (vii) aucune compensation ne sera offerte si la valeur réelle du prix diffère de sa valeur au détail approximative indiquée (notamment en raison du point de départ ou des fluctuations du coût du transport aérien); (viii) le prix peut différer de l’illustration présentée dans le matériel promotionnel; (ix) en acceptant le prix, le gagnant potentiel renonce (ainsi que son ou ses invités, le cas échéant) à tout recours contre le commanditaire et les autres parties exonérées si le prix ou l’un de ses éléments s’avère insatisfaisant, en tout ou en partie; (x) si le prix comprend un ou plusieurs invités, ceux-ci doivent être âgés d’au moins 19 ans; et (xi) en participant à un prix ou à l’un de ses éléments, le gagnant potentiel (ainsi que chaque invité, le cas échéant) : (a) comprend, reconnaît et accepte que sa participation au prix peut comporter des dangers et une exposition à des risques ou à des dangers (y compris, sans s’y limiter, les risques inhérents aux voyages et les risques liés à une exposition ou une infection potentielle à la COVID-19), résultant d’une erreur humaine ou de négligence prévisibles ou non, et qu’il pourrait subir des dommages matériels, des blessures graves, une maladie ou même le décès; (b) reconnaît et accepte que les parties exonérées (telles que définies ci-dessous) n’ont émis aucune garantie, promesse, ni déclaration concernant sa sécurité pendant sa participation au prix.
Les parties exonérées (telles que définies ci-dessous) ne sont pas responsables du retard, du report, de la suspension, de la reprogrammation ou de l’annulation, pour quelque raison que ce soit (y compris, sans s’y limiter, en raison d’une maladie ou de risques pour la santé, ou de toute ordonnance, mesure, directive ou orientation du gouvernement ou des autorités sanitaires en réponse à une telle maladie ou à de tels risques comme, sans s’y limiter, celles qui peuvent être mises en œuvre pour atténuer la transmission de la COVID-19, ou en raison de toute autre cause de quelque nature que ce soit), de tout aspect du prix. Ni le gagnant potentiel (et, le cas échéant, son ou ses invités) ni aucune autre personne ou entité ne seront dédommagés en cas de retard, d’annulation ou de tout autre événement envisagé dans le présent règlement. Le gagnant potentiel et son ou ses invités, le cas échéant, seront seuls responsables du respect de tous les protocoles liés à la COVID et autres, y compris, sans s’y limiter, les vaccinations obligatoires, les tests et les exigences de dépistage.
Aucune des parties exonérées (telles que définies ci-dessous) ne fait de déclaration ni n’offre de garantie, expresse ou tacite, de fait ou de droit, quant à la qualité, l’authenticité, la qualité marchande, l’état mécanique et l’adéquation à un usage particulier du prix attribué dans le cadre du concours. Dans toute la mesure permise par la loi applicable, le gagnant potentiel comprend et reconnaît qu’il ne peut pas demander de remboursement ou exercer un recours légal ou en equity auprès du commanditaire ou de l’une des autres parties exonérées si le prix n’est pas adapté à un usage particulier ou s’il est insatisfaisant de quelque manière que ce soit.
En participant à ce concours et en acceptant le prix, le gagnant potentiel convient d’adopter, ainsi que son ou ses invités, le cas échéant, un comportement conforme à toutes les lois applicables et des pratiques sociales généralement acceptées lors de sa participation à toute activité associée au concours ou au prix. Le gagnant potentiel comprend et accepte que le commanditaire (ou un fournisseur de prix) a le droit, à sa seule discrétion, de disqualifier et de retirer le gagnant potentiel ou son ou ses invités de toute activité, en tout temps, si le comportement du gagnant potentiel ou de son ou ses invités est à tout moment récalcitrant ou dérangeant, ou s’il peut causer ou a causé des blessures, des dommages, ou s’il peut nuire ou a nui à la réputation de toute partie liée au concours ou s’il enfreint de quelque façon que ce soit les politiques des fournisseurs de prix. Dans un tel cas, tous les frais liés au prix resteront entièrement à la charge du gagnant potentiel.
- SÉLECTION DES GAGNANTS. Un tirage au sort sera effectué parmi toutes les participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours afin de sélectionner une (1) participation admissible le ou vers le 21 mai 2026 (la « date de sélection ») au 1209 King Street West, local 200, Toronto (Ontario) M6K 1G2 par le commanditaire ou ses représentants désignés, et ce participant sélectionné sera réputé être le gagnant potentiel.
Les chances de gagner dépendent du nombre de participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours.
- PROCESSUS DE NOTIFICATION DU GAGNANT. Le commanditaire ou son représentant désigné effectuera un minimum de deux (2) tentatives pour contacter le gagnant potentiel (à l’aide des renseignements fournis au moment de la participation) dans les deux (2) jours ouvrables suivant la date de sélection. S’il s’avère impossible de joindre le gagnant potentiel dans les deux (2) jours ouvrables suivant la date de sélection ou si un avis est retourné avec une mention d’échec de livraison, le gagnant potentiel sera alors disqualifié, à la seule discrétion du commanditaire (et, étant disqualifié, il perdra tous ses droits liés au prix), et le commanditaire se réserve le droit, à sa seule discrétion et si le temps le permet, de sélectionner un autre gagnant potentiel en fonction du même processus de sélection du gagnant décrit ci-dessus (avec les modifications nécessaires), et dans un tel cas, les dispositions précédentes de la présente section s’appliqueront au nouveau gagnant potentiel. Le commanditaire ne communiquera pas avec les participants, sauf avec les participants sélectionnés. Le commanditaire ne peut être tenu responsable dans l’éventualité où un participant sélectionné ne recevrait pas l’avis ou que sa réponse ne lui parviendrait pas.
- PROCESSUS DE CONFIRMATION DU GAGNANT. AVANT D’ÊTRE DÉCLARÉ GAGNANT CONFIRMÉ DU PRIX, le gagnant potentiel devra : (a) répondre correctement, sans aide mécanique ou autre, à une question réglementaire d’arithmétique (laquelle pourra, à la seule discrétion du commanditaire, être administrée en ligne, par courriel ou autre moyen électronique, par téléphone ou dans le formulaire de déclaration de conformité et d’exonération de responsabilité du commanditaire); et (b) signer et retourner, dans les deux (2) jours ouvrables suivant la notification, le formulaire de déclaration de conformité et d’exonération de responsabilité du commanditaire, lequel (entre autres) : (i) confirme le respect du présent règlement; (ii) confirme l’acceptation du prix tel qu’attribué; (iii) libère les parties ainsi que leurs successeurs et ayants droit respectifs, les régies des alcools provinciales et les établissements licenciés participants (collectivement, les « parties exonérées ») de toute responsabilité, directe ou indirecte, liée au concours, y compris, sans s’y limiter, à l’utilisation des renseignements fournis par le gagnant potentiel dans le cadre du concours (en tout ou en partie), à sa participation au concours, à l’attribution, à la réception, à la possession, à l’utilisation ou à la mauvaise utilisation du prix (ou de toute portion de celui-ci), ou à l’atteinte à des droits de propriété intellectuelle, à des droits à l’image, à des droits à la vie privée ou à tout autre droit ou intérêt d’un tiers, y compris ceux relatifs à la publicité ou à la personnalité; et (iv) accepte la publication, la reproduction et toute autre utilisation de son nom ou de son image, sans autre avis ni compensation, à perpétuité dans le monde entier, dans toute publicité ou annonce réalisée par le commanditaire ou en son nom. Cette exonération restera en vigueur après la fin du concours et de l’attribution du prix. Le cas échéant, le ou les invités du gagnant potentiel peuvent également, à la discrétion du commanditaire, être tenus de signer dûment les documents du concours dans le délai imparti, à titre de condition de participation à un prix ou à une portion de celui-ci. Cette exonération restera en vigueur après la fin du concours et/ou la participation du ou des invités au prix ou à une portion de celui-ci.
Si un gagnant potentiel : (a) ne retourne pas les documents du concours dûment signés dans le délai imparti; (b) ne répond pas correctement à la question réglementaire; (c) ne peut pas accepter (ou ne veut pas accepter) le prix (tel qu’il est attribué) pour quelque raison que ce soit; (d) a, à quelque étape que ce soit, fourni des renseignements faux, incomplets, inexacts ou trompeurs (tels que déterminés par le commanditaire, à sa seule discrétion); ou (e) est considéré comme étant en infraction au présent règlement (le tout tel que déterminé par le commanditaire à sa seule discrétion), il sera disqualifié (et perdra tous ses droits au prix) et le commanditaire se réserve le droit, à sa seule discrétion et si le temps le permet, de sélectionner au hasard un autre gagnant potentiel conformément aux modalités de sélection des gagnants décrites ci-dessus (auquel cas les dispositions précédentes de cette section s’appliqueront à ce nouveau gagnant potentiel sélectionné).
DISPOSITIONS GÉNÉRALES
- Les régies des alcools provinciales ne sont aucunement associées au concours ni responsables de toute question relative au concours.
- Le concours n’est en aucun cas parrainé, approuvé ou administré par Instagram, pas plus qu’il n’y est associé. Le participant convient qu’il fournit ses renseignements au commanditaire, et non à Instagram. Les renseignements fournis ne seront utilisés que pour administrer le concours conformément à la politique de protection de la vie privée du commanditaire. Le participant au concours dégage entièrement Instagram de toute responsabilité. Toute question, remarque ou plainte concernant le concours doit être adressée au commanditaire, et non à Instagram.
- Le concours est régi par les lois du Canada et de la province de la Colombie-Britannique, et le participant accepte par la présente la juridiction exclusive des lois de la Colombie-Britannique pour les causes ou litiges découlant du concours. Le participant renonce à toute objection concernant la juridiction et la compétence de ces tribunaux.
- Toutes les participations deviennent la propriété du commanditaire. Le concours est nul là où la loi l’interdit et assujetti à toutes les lois fédérales, provinciales et municipales applicables. Les décisions du commanditaire concernant tous les aspects du concours sont définitives et exécutoires pour tous les participants, sans droit de recours, y compris, sans s’y limiter, toute décision concernant l’admissibilité/la disqualification des participations et des participants. TOUTE PERSONNE QUE LE COMMANDITAIRE CONSIDÈRE, POUR QUELQUE RAISON QUE CE SOIT, COMME ÉTANT EN CONTRAVENTION AVEC LE PRÉSENT RÈGLEMENT POURRA ÊTRE DISQUALIFIÉE À TOUT MOMENT, À LA SEULE DISCRÉTION DU COMMANDITAIRE.
- En s’inscrivant au concours, chaque participant accepte de se conformer au présent règlement et de dégager le commanditaire et les autres parties exonérées de toute responsabilité en cas de préjudice au gagnant potentiel découlant de la participation au concours, du respect ou non-respect du présent règlement et de l’acceptation, de l’utilisation ou de la mauvaise utilisation du prix, et chaque gagnant potentiel sélectionné accepte de signer la déclaration de conformité et d’exonération de responsabilité du commanditaire (voir l’article 7 ci-dessus) à cet égard avant de recevoir son prix. Les parties exonérées se dégagent de toute responsabilité se rattachant au concours ou au prix attribué.
- Toutes les participations peuvent faire l’objet d’une vérification en tout temps et pour toute raison. Le commanditaire se réserve le droit, à sa seule discrétion, d’exiger une preuve d’identité et/ou d’admissibilité (sous une forme acceptable pour le commanditaire – y compris, sans s’y limiter, une pièce d’identité avec photo émise par le gouvernement) : (i) dans le but de vérifier l’admissibilité d’une personne à participer à ce concours; (ii) dans le but de vérifier l’admissibilité ou la légitimité d’une participation ou de toute autre information soumise (ou prétendument soumise) aux fins du concours; ou (iii) pour toute autre raison que le commanditaire juge nécessaire, à sa seule discrétion, dans le but d’administrer le concours conformément à la lettre et à l’esprit du présent règlement. Le fait de ne pas fournir dans le délai imparti une telle preuve à l’entière satisfaction du commanditaire peut entraîner la disqualification du participant, à la seule discrétion du commanditaire.
- Il est interdit de donner ou de vendre des participations, et le commanditaire se réserve le droit de refuser une participation s’il considère qu’elle a été soumise par une personne inadmissible ou au moyen d’un système ou programme automatisé, robotisé, généré par macro-instruction, par script ou autre. Le participant doit prouver son admissibilité à l’aide d’une pièce d’identité avec photo valide et d’une preuve de résidence, sur demande.
- En cas de litige concernant l’identité de la personne ayant soumis une participation, le commanditaire se réserve le droit, à sa seule discrétion, d’exiger que toute personne prétendant être à l’origine de ladite participation fournisse la preuve, à l’entière satisfaction du commanditaire (à sa seule discrétion), qu’elle est bien l’auteur de la participation en question. Le fait de ne pas fournir dans le délai imparti une telle preuve à l’entière satisfaction du commanditaire peut entraîner la disqualification du participant (tel que déterminé par le commanditaire à sa seule discrétion).
- Le commanditaire se réserve le droit, à sa seule discrétion, de retirer, de modifier ou de suspendre le concours (ou de modifier le présent règlement) de quelque manière que ce soit, en cas de cause indépendante du contrôle raisonnable du commanditaire qui contreviendrait au bon déroulement du concours, tel qu’il est décrit dans le présent règlement, y compris, sans s’y limiter, une erreur, un problème technique, un virus informatique, un bogue, un trafiquage, une intervention non autorisée, une fraude ou une défaillance technique, et, le cas échéant, sous réserve de l’approbation d’une régie des alcools provinciale. Le commanditaire, à sa seule discrétion, se réserve le droit d’annuler, de modifier ou de suspendre le concours, ou de modifier le présent règlement, de quelque manière que ce soit, sans préavis ni obligation, en cas d’accident, d’erreur d’impression, d’erreur administrative ou autre, ou pour toute autre raison que ce soit. Sans limiter la portée générale de ce qui précède, le commanditaire se réserve le droit, à sa seule discrétion, d’administrer une autre épreuve réglementaire s’il le juge approprié en fonction des circonstances ou afin de se conformer à la législation applicable. Le commanditaire se réserve le droit, à sa seule discrétion, d’ajuster les dates, les périodes et/ou les autres modalités du concours prévues dans le présent règlement, dans la mesure nécessaire, afin de vérifier la conformité d’un participant ou d’une participation au présent règlement, ou en raison de problèmes techniques ou autres, ou en considération de toute autre circonstance qui, de l’avis du commanditaire, à sa seule discrétion, compromet la bonne administration du concours, telle qu’elle est décrite dans le présent règlement, ou pour toute autre raison.
- Le commanditaire et les autres parties exonérées n’assument aucune responsabilité en cas d’incapacité d’un participant potentiel à s’inscrire au concours pour quelque raison que ce soit. Les parties exonérées ne seront pas responsables : (i) de toute défaillance d’un site Web pendant le concours; (ii) de tout dysfonctionnement technique ou autre problème de quelque nature que ce soit, y compris, sans s’y limiter, ceux liés au réseau ou aux lignes téléphoniques, aux systèmes informatiques en ligne, aux serveurs, aux fournisseurs d’accès, au matériel informatique ou aux logiciels; (iii) de l’impossibilité de recevoir, de saisir ou d’enregistrer une participation ou toute autre information, pour quelque raison que ce soit, y compris, sans s’y limiter, les problèmes techniques ou la saturation du réseau Internet ou d’un site Web; (iv) de tout dommage ou préjudice subi par l’ordinateur ou tout autre appareil d’un participant ou d’une autre personne, en lien avec la participation au concours ou résultant de celle-ci; et (v) de toute combinaison des éléments ci-dessus. Sans limiter la portée générale de ce qui précède, en s’inscrivant au concours, chaque participant accepte de dégager les parties exonérées de toute responsabilité en lien avec le concours et sa participation.
- Toute tentative délibérée d’endommager un site Web ou de saboter le déroulement légitime du concours de quelque manière que ce soit (tel que déterminé par le commanditaire à sa seule discrétion) constitue une infraction civile et pénale, et le commanditaire se réserve le droit d’intenter une poursuite en dommages-intérêts dans la mesure où la loi le permet.
- En s’inscrivant à ce concours, chaque participant consent expressément à ce que le commanditaire, ses mandataires ou ses représentants conservent, partagent et utilisent les renseignements personnels soumis avec sa participation uniquement aux fins de l’administration du concours et conformément à la politique de confidentialité du commanditaire (qui se trouve à https://sunwelddistilling.com/privacy/). La présente section ne limite aucun autre consentement que la personne concernée pourrait accorder au commanditaire ou à toute autre partie en ce qui a trait à la collecte, l’utilisation et la divulgation de ses renseignements personnels.
- En cas de divergence ou de contradiction entre le présent règlement et les communications ou autres déclarations contenues dans tout matériel lié au concours, y compris, sans s’y limiter, les publicités diffusées sur le site Web, dans les points de vente, à la télévision, en format papier ou en ligne ou toute instruction ou interprétation relative au présent règlement de la part d’un représentant du commanditaire, les modalités du présent règlement prévaudront, régiront et auront préséance dans toute la mesure permise par la loi, à moins que le commanditaire n’en décide autrement, à sa seule discrétion.
- La nullité ou l’inapplicabilité d’une disposition du présent règlement ne pourra compromettre la validité ni la force exécutoire des autres dispositions. Si une disposition du règlement est déclarée non valide ou autrement inapplicable ou illégale, le présent règlement reste en vigueur et doit être interprété selon ses modalités comme si la disposition non valide ou illégale n’en faisait pas partie.
- Pour les résidents du Québec : Un différend quant à l’organisation ou à la conduite d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux afin qu’il soit tranché. Un différend quant à l’attribution d’un prix peut être soumis à la Régie uniquement aux fins d’une intervention pour tenter de le régler.
Veuillez consommer de façon responsable. Le prix ne comporte pas d’alcool.
